LIABILITY RELEASE AGREEMENT 



 ASSUMPTION OF RISK: The undersigned (“you” or “Participant”) acknowledges that he/she is voluntarily participating in dog training provided by Fortis Canine, LLC training with knowledge of the potential dangers. Participant represents that he/she is the owner or guardian of the dog(s) identified in this Agreement. You acknowledge that dogs are unpredictable animals with their own will and drives, and therefore, regardless of training, handling, or environmental circumstance, Fortis Canine, LLC training cannot protect against every potential injury, risk, or accident to you, to other persons participating in the training or on the property where the training is taking place, or to dogs. These may include dog attacks, dog bites and the responsive actions and complications that arise from them, and you understand and acknowledge that such risks are inherent and cannot be eliminated. This Agreement is intended to shift the risk of participating in dog training to you. Do not sign it unless you are willing to assume the risk to yourself, your dog, and others accompanying you of your participation in dog training, including the associated risks of bodily injury, death or property damage while participating in the dog training and related activities on the property of Fortis Canine, LLC training, in your own home, or in a public space. 


RELEASE OF LIABILITY: Participant agrees that in consideration for being permitted to participate in dog training provided by Fortis Canine, LLC training, and/or to use any of Fortis Canine, LLC training’s facilities in connection with dog training, Participant, for himself/herself, and his/her heirs, next of kin, executors, and personal representatives (collectively, “Releasors”), assumes the entire risk associated with participating such an activity and waives, releases, discharges and covenants not to sue Fortis Canine, LLC training, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers or other representatives, their successors and/or assigns (collectively, “Releasees”), from any and all liability to Releasors for any loss, harm, damage, claim, injury (including death) or accident to the person or property of Participant, Participant’s dog, and any other persons accompanying Participant at the dog training, including any minor children, arising out of or related to participating in dog training or using any facilities or equipment of Fortis Canine, LLC training, even if caused by any negligent act or omission of Releasees. Nothing herein is intended to release Releasees from any harm, injury, claim, or damage caused by intentional, wanton or reckless misconduct. 


INDEMNIFICATION: You agree that you are and will be responsible for your conduct and the conduct of your dog and others accompanying you (including minor children) at all times. You agree to indemnify and hold harmless Fortis Canine, LLC training, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers and other representatives (“Fortis Canine, LLC training Personnel”), from any and all claims of injury (including death), loss, cost, expenses, or damage to persons, dogs, or property caused by the acts or omissions of you, your dog, and any other persons accompanying you, including any minor children, during the course of training or related activities, as well as by the conduct of your dog under your own care as a result of following training instructions. This provision applies whether the claims are made by you, members of your family, your accompanying guests, Fortis Canine, LLC training Personnel, or third parties. 


SPECIFIC AUTHORIZATIONS: Fortis Canine, LLC training and its personnel are authorized to enter your home during agreed upon days and hours for the purpose of training your dog. You authorize emergency medical care to be provided for your dog by a veterinarian. You will be responsible for any charges related to emergency care, including office visits, procedures, medications, surgeries, etc. 


NO GUARANTY OF RESULTS: You recognize that the role you play in your dog’s learning process is integral to achieving desired results. You acknowledge and agree that there is no guaranty that your dog will achieve the desired level of training, despite the best efforts of Fortis Canine, LLC training. You further understand that the recommendation of any other product or service by Fortis Canine, LLC training is not a guaranty of satisfaction with that product or service. 


PHOTO/VIDEO RELEASE: I grant Fortis Canine, LLC training, LLC, its representatives, and employees the right to take photographs/videos of me and/or my pet, and to copyright, use and publish the same in print and/or electronically. I agree that Fortis Canine, LLC training may use such photographs/videos of me and/or my pet with or without my name and for any lawful purpose, including, for example, such purposes as publicity, illustration, advertising, and Web content. 


SAVINGS CLAUSE: You expressly agree that the foregoing assumption of risk, release, waiver, and indemnity provisions are intended to be as broad and inclusive as permitted by applicable law, and that if any portion thereof is held invalid, you agree that the remaining provisions will continue in full force and effect. 


Foul Weather Disclaimer: At FORTIS Canine LLC, the safety and well-being of both dogs and their owners is our top priority. Please note that training sessions may be cancelled or rescheduled in the event of foul weather, including thunderstorms, heavy rain, or extreme temperatures.
Cold Weather: Training sessions will be suspended when temperatures drop below 32°F (0°C), as extreme cold can pose health risks for our canine companions. Hot Weather: In South Georgia and North Florida, we prioritize canine safety and recognize that high temperatures can impact your dog’s well-being. Training sessions will be limited or suspended when temperatures exceed 90°F (32°C) to safeguard against overheating and ensure the health and comfort of our dogs. Additionally, training will not take place during electrical storms, including lightning and thunder, to ensure the safety of all participants. We appreciate your understanding and encourage you to check the weather forecast prior to your scheduled training session.


Disclosure of Risks: Engaging in dog training activities involves certain inherent risks. Participants acknowledge and accept the risks associated with dog training, which may include, but are not limited to, the following: Dog Bites: There is a risk of being bitten by a dog during training sessions. This may occur due to fear, aggression, or miscommunication between the handler and the dog. Dog Aggression: Dogs may display aggressive behavior towards other dogs or individuals, potentially leading to injuries. Falls and Collisions: Participants may experience falls or collisions with dogs, other participants, or training equipment, which may result in sprains, fractures, or other injuries. Injuries from Handling Equipment: The use of training equipment such as leashes, collars, and harnesses may result in injuries, such as abrasions or entanglement. Exposure to Allergens and Illness: Participants may be exposed to allergens (e.g., dander, hair) and diseases that can be transmitted from dogs to humans. Emotional Stress: Participants may experience emotional distress due to their dog’s behavior, challenges with training, or incidents that occur during sessions. Unpredictable Behavior: Dogs can exhibit unpredictable behavior, and even well-trained dogs may react unexpectedly in certain situations. Environmental Hazards: Training may take place in various environments that could present hazards, such as uneven ground, weather conditions, or nearby traffic. By participating in dog training sessions, you acknowledge that you have been informed of these inherent risks and agree to accept full responsibility for any injury or damage that may occur during training.

Cancellation Policy: We understand that circumstances may arise that require you to cancel or reschedule your training sessions. To maintain a fair and professional scheduling process, we have established the following cancellation policy: Cancellation Notice: Participants must provide at least 48 hours’ notice to cancel or reschedule any training session. This allows us to adjust our schedule and offer availability to other clients. Late Cancellations: Cancellations made less than 48 hours prior to the scheduled session will result in a cancellation fee equal to 50% of the training session fee. This fee will be deducted from your deposit or billed to you directly. No-Show Policy: If a participant fails to attend a scheduled training session without prior notice, a fee of $100 will be charged. This fee reflects the hourly rate for the training session that was missed. Rescheduling Policy: If you provide the required notice, you may reschedule your training session without penalty. The new date must be within 30 days of the original session to ensure the continuity of training. Exceptional Circumstances: We understand that emergencies can occur. If you experience an exceptional circumstance, please reach out to us, and we will consider your situation on a case-by-case basis. We appreciate your understanding and cooperation in adhering to our cancellation policy, which helps us provide the best possible service to all our clients.


Deposit Policy: To secure your training reservation, a deposit equal to 50% of the quoted training fee is required prior to the commencement of any training program. This deposit confirms your scheduled training dates and allows us to allocate the necessary time and resources for your dog’s individualized training plan. The remaining balance will be due upon completion of the training program, unless otherwise specified in your service agreement. Please be advised that deposits are non-refundable but may be applied toward rescheduled sessions, provided notice is given within the agreed-upon time frame. We appreciate your understanding and cooperation in maintaining a structured and professional training schedule.


KNOWING AND VOLUNTARY EXECUTION: By agreeing with this document, you declare that you are at least 18 years of age and competent to this Agreement. You acknowledge that you have carefully read this Agreement, understand its contents, and agree to be bound by its terms. You specifically understand that this Agreement includes an assumption of the risk of Fortis Canine, LLC training’s negligence and a release of Fortis Canine, LLC training’s liability.
